General Terms and Conditions of Trade

1. Acceptance

Teefunder provides this site (teefunder.co.uk) to you subject to the terms contained in this document (agreement). If you do not agree with any of the terms of this agreement, do not access or otherwise use this site. Your use of this site shall be deemed to be your agreement to abide by each of the terms set forth below. It is the responsibility of the customer to read such conditions before entering upon a transaction.

By registering with teefunder.co.uk, you represent that you are of legal age to form a binding contract. You agree to provide true, accurate, current and complete information about yourself in all required fields of the registration form. If any of your information changes, you agree to update your registration information as soon as possible. If teefunder.co.uk suspects that your registration information is not complete, current, or accurate, or that you have otherwise violated these Terms of Use, your account may be subject to suspension or termination, and you may be barred from using the teefunder.co.uk website.

2. Privacy Policy

Your privacy is very important to us at teefunder. Users should refer to our privacy policy for information about how teefunder collects and uses personal information. Details of how we use information you provide is set out in our privacy policy. By agreeing and accepting this agreement you consent to teefunder disclosure and use of your information as described in the privacy policy.

3. User Account, Password & Security

The creation of an account is optional to purchase from teefunder. However if you choose to register you will receive a password and user account. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities that occur under your account. You agree to (1) immediately notify teefunder of any unauthorised use of your password or account or any other breach of security and (2) ensure that you exit from your account at the end of each session. teefunder cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Proprietary Rights (Trademarks & Copyright Notice)

You acknowledge and agree that any content, including but not limited to text, data, photos, graphics, etc. or material contained or distributed through the site, by teefunder, its advertisers or third parties, is protected by trademarks, service marks, patents, copyrights, or other proprietary rights and laws.

You therefore may not under any circumstances use or distribute any content received through the site without authorization of the content owner. You agree not to publish, reproduce, copy, in whole or part, nor upload, download, post, email, sell or otherwise distribute content available through the site.

You retain all ownership rights to your content submitted to the site. However by submitting your content to the teefunder online t-shirt designer, you grant teefunder a nonexclusive, worldwide, transferable license to use, copy, reproduce, modify, publicly display, and distribute your content.

5. Intellectual Property Policy

We respect the intellectual property right of others, therefore we ask you to do the same.
Licensed or copyright images, logos or trademarks must not be submitted to reprint without the consent of the owner. The clothing designed by the user is printed by Teefunder as part of an automated printing service and therefore Teefunder is not responsible for the selection of images, design(s) or the content of the materials printed.
Teefunder shall not be liable for any claim or expense arising out of any illegal matter printed for the customer. The customer shall carry any legal costs incurred in such matter.

6. Rules of Conduct

The following rules of conduct apply to your use of the website and to any and all materials you post on teefunder.co.uk, including text, data, graphics, audio or video content, music, sound, chat, messages, files or any other material (collectively user submissions) whether the user submission is included in blogs, discussion groups, emails, profiles, comments, or any other portion or feature of teefunder.co.uk

7. Terms of Campaign (Setting up a Campaign Fundraiser)

By setting up a campaign using the teefunder service you agree to the following terms and conditions.

The Teefunder Service allows sellers to create fundraising campaigns and sell custom merchandise and apparel through those campaigns. The following are specific obligations concerning the initiation of any campaign. To the extent any campaign violates these Terms of Service, we may choose to terminate, delay or modify the campaign at our discretion.


a. Copyright

By creating a campaign through the Teefunder Service, you represent and warrant that you own or are the licensee of all trademark rights, copyrights, rights of publicity and other intellectual property or other proprietary rights necessary to create and conduct the campaign ("campaign rights" ) including any rights relating to the name, description, images, text or URL used for the campaign.

Teefunder does not claim any ownership rights in the content you upload to the Teefunder Service. For the purpose of implementing and fulfilling your campaign and for the purpose of advertising the Teefunder Service in any medium Teefunder chooses, you hereby grant Teefunder a nonexclusive, worldwide, fully paid up, transferable, sublicensable license under your Campaign Rights to copy, display, distribute, modify the content you upload to the Teefunder Service (including all related images, text, content and information). Any such amendments will be approved by you.


b. Charities/Fundraising

You represent and warrant that any campaign you create that implicitly or explicitly relates to a charity or fundraising effort is authorised by such charity or fundraising effort, and you will ensure that your campaign description clearly and accurately states the percentage of proceeds that will be donated and to whom those proceeds will be donated.


c. Profit per item

In agreeing to run a campaign via Teefunder you have no financial obligation as Teefunder will supply garments or merchandise, print the product, process payments, and deliver all orders. Your profit is calculated from a percentage of the total sales price after VAT has been deducted. The money you’ll earn per item sold will be provided to you by Teefunder before you launch your campaign. Designing a campaign and the sales being generated during the campaign can be monitored via your dashboard.


d. Payment Terms

Your campaign profits will be paid to you within 10 working days of the campaign end date or every 28 days if running an ongoing campaign. Payment can also be made fortnightly if preferred. This will be paid via your chosen method of payment; Paypal, Bank Transfer or Cheque.


e. Delivery of Orders

All customers orders are printed and delivered within 7 days after the campaign end date. If running an ongoing campaign Teefunder will print and dispatch orders every 14 days.


f. Campaign Length

When creating a campaign you have a set time limit during which your campaign will be active. This can be extended at any time and is at your discretion.


g. Contract

You may not, in connection with the Teefunder Website: Upload, post, email or otherwise transmit any user submission that is libellous or defamatory, pornographic, sexually explicit, unlawful or plagiarized; infringes or violates any patent, copyright, trademark, trade secret or other property right; a reasonable person would consider harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way; constitutes a breach of any person’s privacy or publicity rights, a misrepresentation of facts, or hate speech; violates or encourages others to violate any applicable law, statute, ordinance or regulation;


8. Terms of Sale

By placing an order you are offering to purchase a product(s) on and subject to the following terms and conditions.


a. Delivery/Shipment & Costs

Any dates provided for delivery are an approximate only.
A shipment service provider chosen by teefunder shall conduct delivery.
Orders will be dispatched via Royal Mail and for larger parcels a Courier Service.
Any goods returned to teefunder described as undeliverable, will be subject to a redelivery charge.
Teefunder reserves the right to cancel any order for any product that may violate intellectual property rights of a third party and will notify the purchaser that the order has been cancelled


b. Overseas Delivery

Overseas delivery is available and the cost is given in your shopping basket. We use the Royal Mail or Courier service for all overseas deliveries, all of which are trackable online when dispatched to you.
Parcels leaving the British Isles shall be identified with a customs label identifying the contents of the parcel. This may be examined by customs and you may be liable for custom duties and taxes


c. Prices

All Prices on our website and that we quote are in British Pounds Sterling (£GBP)
Prices and Products may change at teefunder's discretion.
Prices given include the statutory incidental taxes, in particular Value Added Tax (VAT).
Postage and Packaging is charged for separately and shown separately on the invoice.


d. Payment Terms

Online payment will be carried out according to the customer’s choice of debit/credit card, or PayPal.
The customer shall always pay for goods prior to print and dispatch.


e. Damaged Goods

Any faulty or damaged goods should be reported to teefunder within 2 days of the product(s) being delivered. You should include full and precise details as to the nature of the damage.
The customer must provide teefunder with the faulty goods to enable us to inspect the same.
In the event of any faulty or damaged goods, the goods will be replaced.
In the case of returns due to damage teefunder will pay for the cost of postage.
A refund or replacement will not be offered in the instance that an image of poor quality has been supplied by the customer and printed by teefunder.


f. Alterations & Cancellation

The customer does not have the right to reject or return goods without the consent of teefunder.
Teefunder will attempt to make any amendments to requested orders in a timely manner. However if this request is received after the product has been printed, teefunder shall not be liable for the cost of a reprint.


g. Errors and Inaccuracies

Teefunder does not take responsibility for any customer errors or spelling mistakes on orders when placed online.


h. Colour & Sample Matching

All colour swatches on our website and that we provide are matched as closely as possible to represent the colour of the selected garment/text/design. However this is not always an exact representation due to various factors so we are unable to guarantee an exact match. Should you have any concerns regarding this you should “ask before ordering” as any customer complaints relating to the graphic swatch and/or actual garment colour when receiving will be non refundable. The customer must therefore accept responsibility for their chosen colours before placing a firm order.


i. Online Design Service

Teefunder offers an online service that allows customers the opportunity to create and view an illustration of their chosen design/text and uploaded images on our products. Teefunder then resizes this image to provide the customer with a product of optimal quality. We accept no responsibility for poor images/designs submitted to us. The higher quality of image, the better the print. Refer to the Help & FAQs as to what files/sizes work best. Licensed or copyright images, logos or trademarks must not be uploaded without the consent of the owner. When submitting your content to the teefunder online designer, you grant teefunder a nonexclusive, worldwide, transferable license to use, copy, reproduce, modify, publicly display, and distribute your content.


9. Links

Teefunder.co.uk (the site), or third parties may provide, links to other websites or resources. As teefunder have no control of such sites and resources, you acknowledge and agree that teefunder is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources or the policies or such sites and resources.
Teefunder is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource

10. Public Reputation

You acknowledge and agree that you will not use any product ordered from the Site in a way that would be damaging to Teefunder reputation or that of its employees, directors, licensors or partners.

11. Variations/Correction of Errors and Inaccuracies

Teefunder uses reasonable endeavours to ensure the information on the site is accurate, however the information and product listings on the site may contain typographical errors or inaccuracies and may not be complete or current. We make no representation or warranty that any information is accurate, complete, or up-to-date and, to the fullest extent permitted by law, we accept no liability for any loss or damage caused by any reliance placed on such information placed by you or anyone to whom you may communicate such information.

Teefunder shall have the right at anytime without any liability or notice to amend, remove any content of the site including prices, sales literature or other documents as long as such alterations do not materially affect the quality of the goods.

Teefunder.co.uk makes no representations that the Website is appropriate or available for use in other locations. Those who access or use the Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

14. Indemnity

You agree to indemnify, defend and hold teefunder, its employees, directors, officers, affiliates, agents, and licensors harmless from any and all judgments, losses, awards, liabilities, costs and expenses (including and not limited to, legal fees) arising out of or based on (1) the content you submit, or transmit through the site (2) your use of the site (3) your connection to the site (4) your violation of the agreement (5) your violation of any rights of a third party.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by and constructed in accordance with English Laws, and in the event of any disputes or claims associated with the terms and conditions will be subject to the jurisdiction of the courts of England

16. Security Policy (Payments)

Our Payment Service Provider is Sage Pay (formerly Protx) – the largest independent payment service provider (PSP) in the UK and Ireland. Sage Pay provides a secure payment gateway (Level 1 PCI DSS), processing payments for thousands of online businesses, including ours. It is Sage Pay’s utmost priority to ensure that transaction data is handled in a safe and secure way.
Sage Pay uses a range secure methods such as fraud screening, I.P address blocking and 3D secure. Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards.
Sage Pay is PCI DSS (Payment Card Industry Data Security Standard) compliant to the highest level and maintains regular security audits. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable.
Sage Pay is an active member of the PCI Security Standards Council (PCI SSC) that defines card industry global regulation.

17. Data Protection

Teefunder uses personal data of the customer for appropriate purposes and according to statutory regulations. The personal data given (i.e. name, email address, delivery address, bank details) for ordering products is used by teefunder for fulfilment and handling of the contract only. This data is treated confidentially by teefunder and is not given to any third parties who are not part of the ordering, delivery and payment procedures. The customer shall be entitled to access information on their personal data which teefunder has saved about them, free of charge. They are also entitled to the correction of incorrect data, and the deletion of their personal data if they choose so, as so long there is no legal obligation to retain such data.

18. Violations of These Terms of Use

If you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bring court proceedings against you.

We expect our suppliers to consistently provide an environment, which protects their employees' health and safety and basic human rights.

We also look to our suppliers to instil these principles when dealing with their own supplier base. Teefunder recognises the importance of being proactive and doing everything within its power to support the rights of those involved in the manufacture of its goods.
